Who is processing your data?

STREAMS CHARTS Public Organization is the data controller for the processing of your personal data. We are a Ukrainian public organization located at: Ukraine, 01104, Kyiv, Lesi Ukrainki, 29.

For the performance of certain services, your data may be controlled by STREAMS CHARTS Public Organization in the state of Ukraine.

The information that STREAMS CHARTS Public Organization collects

We collect information from or about you in the following ways:

Information provided by you

Information provided by you when you create or update your account(s); while you use our tools or services; when you use any of our services for purchases or financial transactions; and while you are receiving customer service support.

Information we get or generate from your use of our services

We collect data related to: the services that you use and how you use them, and your activities when you install or access our services.

Session, device, and security log data

When you access or use our Service, we may automatically collect and generate certain technical and usage data to help secure accounts, prevent fraud and abuse, and enforce subscription and access limitations. This data may include:

  • IP address;
  • device and browser identifiers;
  • login timestamps;
  • session identifiers;
  • approximate geographic region derived from IP address (e.g., country/region);
  • signals indicating concurrent usage patterns.

We do not use this information to infer precise location. We process this session, device, and security log data on the basis of our legitimate interests in securing the Service and preventing fraud and unauthorized access (Article 6(1)(f) GDPR). We have assessed that these interests are not overridden by the interests of data subjects, given the limited scope of data collected and the security-focused purpose of this processing.

Identity resolution (IP-to-company) and sales intelligence

We may use an identity resolution technique commonly described as IP-to-company to infer the organization that is associated with a website visit. This helps us understand which companies are interested in our Service (sales intelligence) and to detect suspicious or abusive activity.

How it works: when your device connects to our website, we receive your IP address and related technical data. We may use internal methods and/or specialized service providers to match the IP address to publicly available information about the likely organization (for example, company name and domain, industry, approximate location at the city/region level, and company size range).

We do not attempt to identify individual visitors through IP-to-company matching, and the results are used at an organization level. However, IP addresses may be considered personal data in certain jurisdictions, so we treat this processing as personal data processing.

Legal basis: we process IP-to-company data on the basis of our legitimate interests in understanding B2B demand for our Service and protecting the Service against fraud and abuse (Article 6(1)(f) GDPR), subject to a balancing test. Where IP-to-company processing requires consent under applicable cookie/technology laws, we will request consent before enabling it.

You can object to this processing at any time (see 'User Rights and Data Deletion'). If you object, we will stop using IP-to-company data for sales intelligence purposes for that device/browser, unless we have compelling legitimate grounds or the processing is necessary for security.

Information collected from external sources

We may receive information about you and your activities from third parties when you link to external accounts (such as Facebook, Google, Twitter, Discord, Steam or Twitch) and from advertisers or service providers about your experiences or interactions with them. For example, if you login to a site or app using Facebook Connect you may be asked if you wish to share information from your Facebook account with us. If you use a "like" or a "share" button for a feature on our sites or apps, then the third party may share information with us.

How we use the information we collect

We use the information we collect only in compliance with this Privacy Policy.

In addition to the uses identified elsewhere in this Privacy Policy, we may use your Personal Information to: (a) improve your browsing experience; (b) send information to you which we think may be of interest to you by email; (c) send you marketing communications relating to our business; (d) if you subscribe via Twitch, and your channel is in our database, you will receive newsletters with streamer updates. As a new user, you will receive 3 messages with a presentation of Esports Charts services and products.

We may also use session, device, and security log data to: (a) authenticate users and manage sessions; (b) detect and prevent unauthorized access, account sharing, and other abusive or fraudulent activity; (c) enforce plan-based access rules, including limits on concurrent sessions and multi-user access — processed on the basis of the performance of your subscription agreement (Article 6(1)(b) GDPR); and (d) maintain the integrity, availability, and security of the Service.

We may also use IP-to-company identity resolution outputs to: (a) generate aggregated reports and insights about organizational interest in Esports Charts; (b) route sales inquiries and prioritize outreach; and (c) detect and prevent fraud, abuse, scraping, account sharing, or other violations of our Terms of Service.

We do not use IP-to-company data to deliver cross-context behavioral advertising, and we do not sell or rent IP-to-company data to third parties.

We use Navigational Information to operate and improve escharts.com and the Subscription Service. We may also use Navigational Information alone or in combination with Personal Information to provide you with personalized information about Esports Charts.

If you give us credit card information, we use it solely to check your financial qualifications and collect payment from you. We use a third-party service provider to manage credit card processing. This service provider is not permitted to store, retain, or use the information you provide except for the sole purpose of credit card processing on our behalf.

Third party services

We use trusted third-party service providers (processors) to help us operate, secure, and improve the Service. These providers may process personal data on our behalf under contractual obligations, including confidentiality, security, and restrictions on use.

Examples of categories of service providers include: hosting and content delivery; database and infrastructure providers; payment processing; customer support tools; email delivery; analytics; security and anti-fraud tools; and (where enabled) IP-to-company identity resolution providers for B2B sales intelligence.

Where we use a third-party IP-to-company identity resolution provider, that provider may act as our processor or as an independent controller depending on the specific service and configuration. Where applicable, we will provide information about such providers and the relevant privacy choices in our cookie settings and/or upon request.

We only share personal data with service providers as necessary for the purposes described in this Privacy Policy. We may also disclose personal data to comply with law, to enforce our agreements, or to protect the rights, property, or safety of Esports Charts, our users, or others.

YouTube data is obtained using the YouTube API and is subject to the YouTube's Terms of Service. By continuing to use the site you are agreeing to be bound by the YouTube Terms of Service.

Retention of Personal Information

We retain Personal Information that you provide as long as it is necessary to provide our services to you, or as needed to comply with our legal obligations, resolve disputes and enforce our agreements, and then we securely delete the information. We will delete this information from the servers at an earlier date if you so request, as described in "User Rights and Data Deletion" below.

Session, device, and security logs are retained for a limited period reasonably necessary for security monitoring, abuse prevention, and enforcement of our agreements. In certain cases (for example, suspected fraud or legal obligations), we may retain relevant logs for a longer period, and then securely delete or de-identify them.

More specifically: routine session and security logs are retained for up to 90 days. In cases of suspected fraud, active security investigations, or applicable legal obligations, relevant logs may be retained for up to 24 months, after which they are securely deleted or de-identified. This retention period is the minimum necessary to fulfill the stated security and compliance purposes.

IP-to-company identity resolution data (for sales intelligence) is retained for a limited period that is proportionate to the purpose. Unless a longer period is required for security investigations or legal obligations, we retain organization-level visit logs and related sales intelligence records for up to 12 months, after which they are securely deleted or aggregated and de-identified.

Security of Your Personal Information

We use a variety of security technologies and procedures to help protect your Personal Information from unauthorized access, use or disclosure. We secure the Personal Information you provide on computer servers in a controlled, secure environment, protected from unauthorized access, use or disclosure. When sensitive Personal Information (such as a credit card number and/or geo-location data) is collected on our Websites and/or transmitted to other websites, it is protected through the use of encryption, such as the Secure Socket Layer (SSL) protocol.

User Rights and Data Deletion

You have the right to access, modify, or request the deletion of your Personal Information at any time. If you wish to delete your data from our servers, you can submit a formal request by contacting our support team at [email protected]. Upon receiving your request, we will securely erase your data in compliance with applicable laws and regulations, unless it is required for legal or legitimate business purposes.

If you are located in the European Economic Area (EEA), you have the following additional rights under the General Data Protection Regulation (GDPR):

  • (a) Right of access (Article 15 GDPR) — you may request a copy of the personal data we hold about you.
  • (b) Right to rectification (Article 16 GDPR) — you may request correction of inaccurate or incomplete data.
  • (c) Right to erasure (Article 17 GDPR) — you may request deletion of your personal data where there is no legitimate reason for us to continue processing it.
  • (d) Right to restriction of processing (Article 18 GDPR) — you may request that we restrict processing of your personal data in certain circumstances.
  • (e) Right to data portability (Article 20 GDPR) — you may request that we transfer your personal data to you or to a third party in a machine-readable format.
  • (f) Right to object (Article 21 GDPR) — you have the right to object at any time to processing of your personal data carried out on the basis of legitimate interests, including profiling. To exercise your right to object, please contact us at [email protected].
  • (g) Rights related to automated decision-making (Article 22 GDPR) — you have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal or similarly significant effects.

If your objection relates to IP-to-company identity resolution used for sales intelligence, please include the URL you visited and, if possible, the approximate date/time of your visit and your IP address (or a screenshot of the request you see in your browser's developer tools). We will make reasonable efforts to honor your request and suppress IP-to-company sales intelligence processing for that device/browser, subject to security and legal requirements.

You also have the right to lodge a complaint with a supervisory authority, in particular in the EU member state of your habitual residence, place of work, or place of the alleged infringement.

Affiliated Entities

The data on our websites is based on aggregated information, including, but not limited to, open-source contributions and references to governments, government flags (including those of sanctioned or sub-sanctioned countries such as the Russian Federation, Syrian Arab Republic, Islamic Republic of Iran, and Republic of Cuba), and organizations or individuals associated with streamers, players, teams, clubs, or other organizations. Any such references on escharts.com or streamscharts.com do not mean or imply any connection, endorsement, or cooperation between our resources and those governments, organizations, or individuals.

Non-engagement with Sanctioned Entities

STREAMS CHARTS adheres strictly to international sanctions. We do not conduct business with any country, entity, or individual subject to these restrictions. This includes individuals, organizations, and states identified in sanctions lists provided by relevant international authorities. We reserve the right to withhold, refuse to collect, or refrain from publishing any data related to events, tournaments, streamers, or content associated with sanctioned entities. This decision is at our sole discretion and does not require further explanation.

If an individual or entity under sanction gains access to our services through misrepresentation or false identification, we reserve the right to terminate all access without refund upon discovery. This action reinforces our commitment to compliance with international laws and ethical standards.

STREAMS CHARTS, in alignment with global standards, does not support or engage with countries or entities involved in terrorism, those sponsoring terrorism, or any aggressor states. We are committed to ethical business practices and the protection of international peace.

Deleting an Esports Charts account

You can cancel your subscription in your profile on the site. If you cancel your subscription, you will still have access to the content until the end of the paid period.

If you delete an account:

  • You will not be able to regain access to it or reactivate it.
  • Your profile, photos, publications, and other content will be deleted and cannot be reactivated.
  • We'll delete your account as soon as you request and approve it via your email
  • Copies of some content (such as journal entries) may remain in our database, but any personal identifiers will be removed.
  • If you use your Esports Charts account to log in to other resources, such as streamscharts.com or app.escharts.com, deleting it will also delete information associated with those resources, including your purchases from the resources and you will no longer be able to use the "Log In via Esports Charts" feature. In addition, you will no longer be able to use subscriptions paid for from your account. To restore your accounts on other resources, you may need to contact support for those resources.
  • Pages managed only by you will also be deleted.
  • Your profile, photos, publications, and other content will be permanently deleted and cannot be recovered.
  • Personal information associated with the account such as deletion of email, deletion from mailing list database, deletion of user attributions, deletion of listings and filters on Esports Charts resources.
  • Social data from linked platforms, including Facebook, Twitter, Gmail, Twitch, Discord, and Trovo, will be deleted.

Before deleting an account, we recommend logging in and downloading a copy of your Esports Charts information, as well as a copy of the information associated with other platforms or sites. Once you delete an account, you will not be able to restore the content it contains.

It is not possible to restore an account after it has been deleted from Esports Charts.

To permanently delete an account:

  • In the main profile under Overview, click the “Delete Account” button on the bottom left-hand side of the page.
  • A window will appear to confirm the deletion of your account.
  • You can push the “Cancel” button and the delete procedure will be canceled then, or click the “Yes, delete my account” button.
  • Once you submit a request to delete your account permanently, all that's left is to confirm the deletion.
  • Check your mailbox and use the link to delete your account.
  • Your account is permanently deleted immediately after getting your final confirmation.

Joint Controllership with Twitch Streamers

In the context of displaying viewer engagement metrics (e.g., usernames and watch time) for specific Twitch streams, Esports Charts and the relevant Twitch streamer jointly determine the purposes and means of processing. This constitutes a joint controllership under Article 26 of the GDPR.

Purpose: To display viewer engagement (watch time per stream) and support loyalty programs and real-time community features.

Scope of data: Twitch usernames and cumulative watch time per stream. No sensitive data is collected.

Legal basis: Consent via Twitch authentication (Article 6(1)(a) GDPR) or legitimate interests in community engagement (Article 6(1)(f) GDPR), subject to a balancing test.

Responsibility: Esports Charts manages data collection, storage, and user rights requests. Streamers participate in content display only.

User rights: Viewers may exercise their data rights by contacting [email protected].

This summary reflects the essence of the joint controllership arrangement, in compliance with Article 26(2) GDPR.

Automated Channel Flagging and Disclaimer

Certain channels on our platform may be marked with a flag indicating signs of irregular activity. These flags are generated based on automated statistical analysis of publicly available data and are intended solely to inform users of potential anomalies, such as possible viewer count inflation, external view-botting, or impersonation.

These flags do not constitute an accusation, confirmation, or implication of any wrongdoing, misconduct, or violation of platform rules by the channel or its operators. The presence of a flag is not a definitive statement about the channel's actions or intentions.

If you believe that your channel was flagged in error, you have the right to request a review. To initiate review, please contact us at [email protected] with relevant information and supporting evidence.

We may also use automated security systems to detect fraud or abuse (for example, suspicious login patterns, scraping, or account sharing) and to restrict or suspend access to the Service. Where such measures significantly affect you, you may request human review by contacting [email protected] or support through the Service.

California Privacy Notice (summary)

This section applies only to California residents and is provided for transparency. It is not intended to modify any contract terms.

In the past 12 months, we may have collected the categories of personal information described in this Privacy Policy (such as identifiers including IP address, account identifiers, contact information if you create an account, and internet or other electronic network activity information such as pages viewed and interactions).

We use this information for the business purposes described above, including operating the Service, security and fraud prevention, improving the Service, and (where enabled) B2B sales intelligence (IP-to-company).

We do not sell personal information for money. We do not share personal information for cross-context behavioral advertising. If this changes, we will provide the right to opt out of sale/sharing as required by applicable law.

California residents may request access to, deletion of, or correction of their personal information, and may opt out of certain processing where applicable, by contacting [email protected].

CCPA Definitions and Service Provider Obligations

The following definitions and rules of interpretation apply in this Agreement:

  • (a) CCPA means the California Consumer Privacy Act of 2018, as amended (Cal. Civ. Code §§ 1798.100 to 1798.199), and any related regulations or guidance provided by the California Attorney General. Terms defined in the CCPA, including personal information and business purposes, carry the same meaning in this Agreement.
  • (b) Contracted Business Purposes means the services described in Terms of Use, Public Offer and this Privacy Policy for which the service provider receives or accesses personal information.
  • (c) Customer means a customer that has signed a service agreement with STREAMS CHARTS Public Organization or any of its affiliates
  • (d) Service Provider means STREAMS CHARTS Public Organization

Service Provider’s CCPA Obligations

  • (a) Service Provider will only collect, use, retain, or disclose personal information for the Contracted Business Purposes for which Customer provides or permits personal information access in accordance with the Terms of Service and Customer’s instructions.
  • (b) Service Provider will not collect, use, retain, disclose, sell, or otherwise make personal information available for Service Provider’s own commercial purposes or in a way that does not comply with the CCPA. If a law requires the Service Provider to disclose personal information for a purpose unrelated to the Contracted Business Purpose, the Service Provider must first inform the Customer of the legal requirement and give the Customer an opportunity to object or challenge the requirement, unless the law prohibits such notice.
  • (c) Service Provider will limit personal information collection, use, retention, and disclosure to activities reasonably necessary and proportionate to achieve the Contracted Business Purposes or another compatible operational purpose.
  • (d) Service Provider must promptly comply with any Customer request or instruction [from Authorized Persons] requiring the Service Provider to provide, amend, transfer, or delete the personal information, or to stop, mitigate, or remedy any unauthorized processing.
  • (e) If the Contracted Business Purposes require the collection of personal information from individuals on the Customer’s behalf, Service Provider will always provide a CCPA-compliant notice addressing use and collection methods that the Customer specifically pre-approves in writing. Service Provider will not modify or alter the notice in any way without the Customer’s prior written consent.
  • (f) If the CCPA permits, Service Provider may aggregate, deidentify, or anonymize personal information by acceptable methods under the CCPA, so it no longer meets the personal information definition, and may use such aggregated, deidentified, or anonymized data for its own research and development purposes. Service Provider will not attempt to or actually re-identify any previously aggregated, deidentified, or anonymized data and will contractually prohibit downstream data recipients from attempting to or actually re-identifying such data.

Assistance with Customer’s CCPA Obligations

  • (a) Service Provider will reasonably cooperate and assist Customer with meeting the Customer’s CCPA compliance obligations and responding to CCPA-related inquiries, including responding to verifiable consumer requests, taking into account the nature of the Service Provider’s processing and the information available to the Service Provider.
  • (b) Service Provider must notify Customer immediately if it receives any complaint, notice, or communication that directly or indirectly relates either party's compliance with the CCPA. Specifically, the Service Provider must notify the Customer within 10 working days if it receives a verifiable consumer request under the CCPA.

Subcontracting

  • (a) Service Provider may use subcontractor to provide the Contracted Business Services.
  • (b) For each subcontractor used, Service Provider will give Customer, upon written request an up-to-date list disclosing:
  • (i) The subcontractor’s name, address, and contact information.
  • (ii) The type of services provided by the subcontractor.
  • (iii) The personal information categories disclosed to the subcontractor in the preceding 12 months.

CCPA Warranties

  • (a) Both parties will comply with all applicable requirements of the CCPA when collecting, using, retaining, or disclosing personal information.
  • (b) Service Provider certifies that it understands this Agreement’s and the CCPA’s restrictions and prohibitions on selling personal information and retaining, using, or disclosing personal information outside of the parties’ direct business relationship, and it will comply with them.
  • (c) Service Provider warrants that it has no reason to believe any CCPA requirements or restrictions prevent it from providing any of the Contracted Business Purposes or otherwise performing under this Agreement. Service Provider must promptly notify the Customer of any changes to the CCPA’s requirements that may adversely affect its performance under the Agreement.

Children's privacy

Our Service is not directed to children under the age of 13 (or under the applicable minimum age in your jurisdiction), and we do not knowingly collect personal data from children. If you believe that a child has provided us with personal data, please contact us at [email protected] and we will take appropriate steps to delete such information.
